This website (referred to below as the “Site”) is a property of Cucumberweb S.L and all content, information and images provided on and through the Site may be used solely under the following terms and conditions.

By accessing or using the Site, you agree to be legally bound by these terms and the following conditions. We reserve our right to change these terms at any time and amendments will take effect when posted on this Site.

We only act as the intermediary between the Site users and the participating homeowners so we do not have and never intend to have any contractual involvement in your reservation. When you use the Site to make a reservation for a property, the contract is made directly between you and the homeowner concerned. The rental contract will settled under the part agreement and from the LAU (Ley 29/1994, de 24 de noviembre, de Arrendamientos Urbanos).

The information contained in the Site is provided and updated by the homeowners from time to time and so we cannot ensure the accuracy or completeness of such information.

coolvillas warrant that access to the Site will be uninterrupted and fault free.

Reservation

The prices displayed on the Site according to season are indicated from the homeowners, and they may be different from the prices published by the homeowners elsewhere. Therefore, you should accept the prices according to this Site.

Subject to confirmation by the homeowner concerned and also to your provision of valid and correct credit card information or other forms of payment, your reservation will be irrevocably binding on you upon your clicking on "Confirm the booking" on the Site.

When payment of the guarantee deposit, which is 40% of the rental price, is been made your reservation is completed and you will immediately receive an e-mail as confirmation of your booking. In case you pay by bank transfer, we will temporary reserve the property for 24 hours, and make this reservation definite as soon as the payment is received. If the prepayment is made through bank transfer you will receive a confirmation by e-mail for as well the temporary booking, (the moment you click the "Confirm the booking" button), and the definite booking (the moment we receive your payment).

Our confirmation e-mail will contain relevant information of the reservation and particulars of the property concerned. Please read and check carefully all the information contained in our confirmation e-mail to ensure that they conform to your reservation. Because we communicate through e-mail, it is your duty to provide your accurate e-mail address to us.

Note: When your payment is not received within 24 hours and/or the property is booked by another customer before the payment arrived, we will release the property from reservation. We will refund your payment (minus transaction costs).

After receiving the final payment, which must be made 45 days before arrival, you will receive the final confirmation of your booking. You are required to produce our confirmation booking e-mail when you check in at the property.

When on any reason your reservation is not accepted, we will try our best to provide you with another comparable alternative if possible, in that case you are freely entitled whether to accept such alternative.

We reserves the right to cancel reservations.

Booking Policy

When you make the on-line reservation and you make your payment by credit card you will have to provide us with your credit card information such as the number and expiry date.

When your reservation is confirmed, a guarantee deposit of the 40 % of the rental price clearly displayed through the reservation process will be charged to your credit card in EUROS. If your reservation is not confirmed, your credit card will not be charged.

We accept credit cards like VISA, Eurocard/MasterCard, and other cards as may be specified on our website from time to time. When you make the reservation payment in EUROS by PayPal or bank transfer this is not applicable.

Under no circumstances will coolvillas be liable for any kind of foreign exchange commissions that your bank might charge you.

The outstanding balance of the final payment is due 60 days prior to arrival. When a booking will be made 60 days or less before arrival date, full payment is required.

Note: Please be advised that your booking is completed until we have received full payment of the booking price.

Security and Damage: At arrival a Security and Damage deposit of 200 EURO per person, will be settled by you and will be refunded at departure when you check out, unless no damage is done. Depending on several factors the Security and Damage deposit can be differently on owners request.

When damage or breakages are in total more than the Security and Damage deposit or caused by negligence or intention, there will be no refund and the difference has to be paid before leaving the property.

Cancellation Policy

A cancellation of your reservation must be confirmed in writing. When your reservation is canceled, the payments you already made will not be fully refunded to you, and additional fees will apply, as clearly stated during the reservation process before your clicking on "Confirm the booking" on our Site.

If the cancellation is received 60 days before the arrival date, 10% of the rental price will not be refundable. When a cancellation is made between 60 and 31 days 50% of the rental price will not be refundable and cancellations received 30 days or less prior to arrival are Non-Refundable.

In case of cancellation, we suggest that you should promptly and directly contact us to minimize any penalty or charges payable.

All disputes relating to cancellation of reservation shall be dealt with or settled directly.

*We strongly advise you to have travel insurance with cancellation cover for this purpose.

The property

A description of each property and its facilities, on which our published price is based, appears on the Site. The property’s are self catering villas or apartments. Each one has its own special attraction and is individually designed to the tastes of the owner.

Arriving at and vacating your property: Your property will be available to use from 14:00 unless otherwise stated on your confirmation e-mail. All properties must be vacated by 10:00 a.m. at the latest on the day of departure.

Late arrival: When it is not possible to arrive at the agreed time, please notify us as soon as possible, so we can make the necessary arrangements.

Occupancy: The property provided must only be used by the person(s) shown on the participants list, sharing or assignment is prohibited. Charges may be made for any people occupying the accommodation who are not named at the participants list.

Prior to this charge being paid there will be no contractual agreement between coolvillas and any person not named on participants list. On no account may the number of people, including children, exceed the maximum occupancy stated as in the property description. This will be considered unacceptable behavior and we reserve the right to carry out the action detailed in the "Termination without compensation" section. Please note; children do count towards occupancy of all properties.

All damage or breakages should be reported to the local agent immediately so that we can fix the problem as soon as possible. Although it is not always possible to arrange for someone to immediately repair or replace broken/damaged equipment and items, we will do so as quickly as possible to cause you minimum inconvenience.

Changes: In case that one of the participants withdraws from the holiday, someone else can take their place, only if you inform us in writing at least 14 days before departure. If you decrease the duration of your holiday, this will be treated as a cancellation. If you want to make changes while you are on holiday, for example to extend your stay, this change is subject to availability and must be paid directly.

You cannot change from a property featured in our Site to a last-minute or other special offer property. Send requests for booking changes to the e-mail address on your booking confirmation.

Pets: Pets may only stay in a property with approval of the homeowner. An additional Security and Damage deposit may be required.

Duration: Some properties are only to book for a minimum of two weeks duration. This will be stated at the time of booking.

Termination without compensation

We reserve the right, at our reasonable discretion, to terminate the holidays of people who indulge in serious misconduct or in a not appropriate use or negligently damages of the accommodation. If we do so, that will be under your responsibility to compensate us for any loss we may suffer, including legal costs.

Privacy

We take privacy issues very seriously. Our current privacy policy covers our use of any information you provide. In using the Site you acknowledge and agree to be bound by the terms of our privacy policy carrying out with the LOPD (La Ley Orgánica 15/1999 )requirements.

Disclaimer

By using the Site you agree to comply with all applicable laws, statutes and regulations concerning your use of Our Services and we will not assume any responsibility thereof.

We merely act as an intermediary between you and the homeowner. We therefore are not responsible or liable in any way whatsoever in relation to any dispute arising between you and the homeowners regarding complaints, facilities or otherwise.

Applicable law

In any dispute, controversy, proceedings or claim of whatever nature in relation and concerning an accommodation booked through the Site , Spanish law will be applied.

In the event of any dispute arising out of or in connection with your use of the Site or the Services, such dispute shall first be submitted to the ICC in Barcelona in accordance with the rules and regulations of the International Chamber of Commerce.
